General terms and conditions of sale of Lunetier Ludovic

  1. Scope of application

    • - The present general conditions are applicable to all orders placed with SPRL Lunetier Ludovic, established at 1.000 Brussels, rue Ernest Allard, 14 and hereinafter referred to as "the service provider". They may only be deviated from by written agreement of the service provider.

    • - All orders are subject to a purchase order or a quotation that will be signed by the customer. This document constitutes an irrevocable acceptance of the order.

  2. Price and deposit

    • - For "ready to wear", each frame is labelled.

    • - For the "custom-made", an indicative price list is displayed in store

    • - For "normal" lenses, the order form will include the price requested. For "special" lenses, the order form will include an indicative price which will be adapted, if necessary, according to the price requested by the supplier. If this price varies by more than 20% compared to the indicative price given at the time of the order, the customer shall be informed before the production process begins.

    • - All orders will be subject to a deposit equivalent to plus or minus 20% of the final price. The payment of the down payment shall constitute acceptance of the order, even in the absence of a "purchase order" or "quotation" as provided for in 1.

  3. Orders - retraction

    • - For the "prêt à porter", the order will be considered firm and definitive as soon as the deposit is paid.

    • - For the "made to measure", a detailed estimate of the frame and the possible options chosen can be established at the end of the 2nd appointment (see point 4.).

    • - Whatever the possible moment of retraction of the customer, the paid installments remain acquired to the service provider.

  4. Manufacturing

    • - For the "ready to wear", manufacturing is limited to

      the possible adjustment of the frame to the dimensions of the

      and the placement of the ordered lenses.

    • - For the "made to measure", the manufacturing process

      involves a minimum of 4 visits from the client:

      • 1st visit: discussion of the customer's wishes, taking

        measurement

      • 2 nd visit: presentation by the supplier of the

        design projects, choice of form, material, etc.

        and the desired degree of finish

      • 3rd visit: test of the raw frame

        adjustments, measuring for centering of the

        glasses and choice of glasses

      • 4 th visit: final adjustments, payment of the

        balance and delivery

  1. Deadlines

    • - For the "ready to wear", the delay depends on the one given by the lens manufacturer;

    • - For "made to measure", the manufacturing deadline will be set according to the size of the order book and provided that the customer makes himself available on the dates set for the visits referred to in point 4.

  2. Delivery and payment

    • - Deliveries are made exclusively in our workshops and after payment of the agreed price.

    • - Deliveries can also be made by external transport companies at the customer's request, with the costs for this delivery being submitted to and borne by the customer.

    • - The orders carried out remain the property of the provider as long as the fixed price has not been fully paid.

  3. After-sales service guarantee

    • - For "ready to wear", the provider undertakes to return to the supplier any frames that have a clear manufacturing defect. The guarantee does not cover wear and tear following normal use. He also undertakes to straighten the frames supplied and to change the lenses on the basis of the indicative price list displayed in the store.

    • - For the "made to measure", the service provider gives a lifetime guarantee for any manufacturing defect, it being understood that as it is a handcrafted product, the client accepts small imperfections and irregularities related to the handcrafted processing and the nature of the materials. He also undertakes to adjust the frames as required, to carry out an annual inspection and cleaning, free of charge.

  4. Responsibility

    • - In any event, the liability of the provider is limited to the amount of the contract.

    • - Neither of the parties can be held responsible for the total or partial non-execution of its obligations if this non-execution is due to a fortuitous event or the occurrence of an element of force majeure.

  5. Privacy

- The service provider undertakes to process personal data in accordance with the law of 30 July 2018 on the protection of individuals with regard to the processing of personal data.

10. Applicable law and courts

- The present conditions are subject to Belgian law. In case of dispute, the client will first contact the service provider to seek an amicable solution. Failing this, only the courts of the judicial district of Brussels will be competent, regardless of the place of delivery and the methods of payment accepted.
