Terms and conditions of Lunetier Ludovic SRL

I. Preamble

These General Terms and Conditions of Sale (hereinafter the "General Terms and Conditions") govern all sales made by SRL Lunetier Ludovic, whose registered office is located at 14, rue Ernest Allard, 1000 Brussels, Belgium, registered with the Banque-Carrefour des Entreprises under number BE0628.771.519 (hereinafter the " Maison d'Artisans"), whether :

  • via the website www.ludovicelens.com (hereinafter referred to as “the Site”), or

  • directly in the store or during off-site appointments.

They apply to any natural or legal person (hereinafter referred to as “the Client”) placing an order or making a purchase with theMaison d'Artisans.

II. Scope of application

These General Terms and Conditions define the rights and obligations of the Parties with respect to :

  • the sale of items available in the boutique or on the Site: frames in stock and already produced, accessories (sprays, cases, etc.) or gift vouchers,

  • custom parts manufacturing (MTO),

  • bespoke frame design.

Any order implies full and unconditional acceptance of these General Terms and Conditions. They prevail over any other version or conflicting document, unless expressly agreed otherwise in writing by the Maison d’Artisans.

III. Nature of products

1. Standard products

Non-personalised items offered online or in-store are considered standard: cleansing sprays, gift vouchers, etc. These products can be ordered in-store and via the Site, and can be dispatched after full payment.

2. MTO - Jazz Collection to order

Certain frames in the Jazz collection can be ordered in the size or material of your choice from a limited range of options. These orders are considered personalized under Belgian law (see article IX).

3. Bespoke creations

Made-to-measure creations involve an individualised design process including several appointments with the customer. These pieces are one-of-a-kind, handcrafted in our workshop from materials selected together.

V. Ordering

1. Validation

All orders are subject to either :

  • a signed order form or quotation, or the payment of a deposit by the Customer,

  • or, for online sales, an order confirmation generated automatically after payment.

2. Down payment

For all MTO and bespoke orders, a deposit is required. Unless otherwise specified, this deposit corresponds to at least 20% of the estimated total price. Payment of this deposit makes the order firm and binding.

V. Prices and payment terms

Prices are stated in euros, inclusive of VAT. Delivery costs are specified at the time of order and are borne by the Client unless otherwise stated. Payment may be made by credit or debit card (online or in the boutique), by bank transfer, or by any other method explicitly accepted by the Maison d'Artisans.

The products remain the property of the Maison d'Artisans until full payment has been made.

VI. Delivery times

1. Standard products

Orders are dispatched within 3 to 7 working days of receipt of payment, unless otherwise stated. Delivery is carried out by external service providers. The risks are transferred to the customer as soon as the goods are handed over to the carrier.

2. MTO or bespoke products

Manufacturing lead times are given as an indication, depending on the order book, the availability of materials and the customer's punctuality at scheduled appointments. The customer will be informed as soon as possible of any significant delays.

VII. Returns and cancellation

1. Standard products

In accordance with Belgian law, the Client has a right of withdrawal of 14 days from receipt of the product for any non-personalised item ordered remotely. This right does not apply to products that have been opened or used (e.g. an opened spray). Returns are made at the Client’s expense, in the original packaging, and subject to prior approval by the Maison d'Artisans.

2. Customised and made-to-measure products

Products made to order (MTO) or made-to-measure (bespoke) are not subject to any right of withdrawal or refund, in accordance with article VI.53 of the Belgian Code of Economic Law.

VIII. Warranty and follow-up

1. Standard products

The products benefit from the legal guarantee in force against any defect of conformity.

2. MTO frames

The Maison d’Artisansprovides adjustment and follow-up for made-to-order frames within the limits of normal use.

3. Bespoke frames

Made-to-measure creations benefit from long-term support: adjustments offered, annual inspection and cleaning. Any manufacturing defects are taken care of, while respecting the tolerances inherent in handcrafting and the use of natural materials.

IX. Liability

The liability of the Maison d’Artisans shall be limited to the total amount of the order concerned. Neither party shall be held liable for any delay or failure resulting from a force majeure event.

X. Personal data

The data collected is processed in compliance with the General Data Protection Regulation (RGPD) and the Belgian law of July 30, 2018. It is used exclusively in the context of commercial relations with the Customer.

XI. Applicable law and jurisdiction

These General Terms and Conditions are governed by Belgian law. Any dispute shall first be submitted to an attempt at amicable resolution. Failing this, the French-speaking courts of the judicial district of Brussels shall have sole jurisdiction.
